Terms of service.

1. Agreement

By creating an account on Rooted OS™ ("Service"), you agree to these terms with Olive Root Tech LLC ("we"). If you're agreeing on behalf of an organization, you confirm you have authority to bind that organization. If you don't agree, don't use the Service.

2. Service description

Rooted OS™ is a multi-tenant platform for deploying operational infrastructure (websites, member portals, admin dashboards, workflows) for mission-driven organizations. Specific features depend on your plan and may change with notice.

3. Your account

• You're responsible for keeping your password and magic-link emails secure
• You must give us accurate sign-up information
• You're responsible for everything that happens under your account
• Tell us immediately if you suspect unauthorized access

4. Your data

• You own the data you put into Rooted OS
• You grant us the right to host, transmit, process, and back up that data as needed to deliver the Service
• We don't claim ownership of your content
• You're responsible for the legality of the data you upload
• You can export your data at any time and delete your account; see the Privacy Policy

5. Acceptable use

See the separate Acceptable Use Policy. Violations can result in immediate account suspension.

6. Payment & billing

• Paid plans are billed monthly or annually in advance
• Founders' pricing is locked at the rate displayed when you sign up
• You authorize us (via Square or Stripe) to charge your payment method
• Failed payments may result in account suspension after a 30-day grace period
• You can cancel at any time; you remain responsible for charges already incurred
• We don't offer refunds for partial months unless required by law

7. Trials

• Free trials are 14 days unless extended in writing
• Trial accounts may be limited in some features (e.g., member count cap)
• Trial data is yours; you can export or convert to a paid plan at any time
• Trial accounts that aren't converted within 30 days of expiry may be deleted

8. Uptime & service availability

We aim for 99.5% uptime monthly. We don't currently offer a Service Level Agreement (SLA) with credits. If a customer specifically needs an SLA, contact us for enterprise terms.

We may schedule maintenance with notice. We may take the platform offline without notice in emergencies (e.g., security incident response).

9. AI-generated content

Rooted OS uses Anthropic's Claude to generate copy drafts based on your inputs. These drafts are drafts — you must review them before publishing. AI outputs may contain errors, omissions, or inappropriate content. You are solely responsible for what you publish under your organization's name.

10. Termination

• You can cancel at any time from your account settings or by emailing us
• We can terminate accounts that violate these terms or the Acceptable Use Policy
• On termination, we'll give you 30 days to export your data (free trials: 14 days)
• After the export window, data is permanently deleted per our retention policy

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement) to the maximum extent permitted by law.

Rooted OS is not certified compliant with COPPA, FERPA, HIPAA, or other regulatory frameworks out of the box. We provide tools that support compliance work; we don't certify your compliance. Don't rely on the Service for regulated workflows unless you've explicitly arranged compliant terms with us in writing.

12. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of these terms or the Service will not exceed the greater of:

• $100, or
• the amount you paid us in the 12 months preceding the claim

We are not liable for indirect, incidental, consequential, special, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Olive Root Tech LLC from claims arising out of:

• Your use of the Service in violation of these terms
• Content you upload or publish
• Your violation of any third party's rights
• Your violation of any applicable law

14. Changes to the Service

We may add, change, or remove features. We aim to give 30 days' notice for material changes that reduce functionality you actively use. We may make smaller changes at any time without notice.

15. Changes to these terms

We may update these terms. Material changes will be emailed to account owners with 30 days' notice. Continued use after the effective date constitutes acceptance.

16. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Norfolk, Virginia.

17. Miscellaneous

• If any provision is unenforceable, the rest stays in force
• Our failure to enforce a provision isn't a waiver
• You can't assign these terms without our consent; we can assign them in a merger or acquisition
• These terms are the entire agreement between us
